IP Lawyer (In-House, Brazil)

BrandMonitor

São PauloFull-timeMid LevelOn-site

Job Description

Hello!

We are looking for an experienced and proactive IP Lawyer to join our global legal team and lead enforcement efforts in Brazil.

This is a remote-first position, offering flexibility while working closely with our international legal and business teams. However, the role requires regular attendance at court hearings, enforcement actions, and raids in São Paulo. Therefore, candidates must reside in the city of São Paulo or its metropolitan area.

You'll work directly on protecting the rights of some of the world's most recognized brands through a combination of civil, criminal, and administrative IP enforcement.

The position focuses on hands-on IP enforcement, including drafting and sending claims, managing pre-litigation negotiations, coordinating enforcement actions with public authorities, representing clients in civil and criminal proceedings, and recovering monetary compensation from infringers.

Who are we?

BrandMonitor is a global legal-tech company focused on the protection of intellectual property rights across the world. We proudly represent over 450 international brands across industries such as fashion, luxury goods, electronics, and more in their fight against counterfeiting and IP violations.

Our legal operations span Europe, Asia, MENA, and Latin America, and we are now expanding our legal team in Brazil.

What you will do:

  • Identify and monitor IP infringements throughout Brazil;
  • Draft and send cease-and-desist letters, legal claims, and negotiate settlements;
  • Represent rights holders in pre-litigation, civil litigation, and criminal IP proceedings;
  • Coordinate and participate in search and seizure operations (raids) and enforcement actions with local authorities (Police, Customs, Public Prosecutor's Office, regulatory agencies, etc.);
  • Draft and file powers of attorney, affidavits, criminal complaints, petitions, and litigation documents;
  • Build and maintain strong relationships with law enforcement agencies, courts, investigators, and service providers;
  • Recover monetary compensation through settlements or court decisions;
  • Support the company's legal and business operations in Brazil (contracts, compliance, office setup, banking, and corporate matters, as needed).

What we expect from you:

  • Law degree and admission to the Brazilian Bar Association (OAB);
  • Minimum 3 years of hands-on experience in Intellectual Property (either in-house or at a law firm);
  • Proven experience with IP enforcement, including:
  • Civil litigation;
  • Criminal IP matters, including search and seizure actions, criminal complaints, anti-counterfeiting investigations, and interactions with police and prosecutors;
  • Experience coordinating enforcement actions with public authorities;
  • Strong legal drafting, negotiation, and communication skills;
  • Fluent Portuguese and professional English (written and spoken);
  • Highly organized, proactive, and able to work independently in a global environment;
  • Must reside in São Paulo (city or metropolitan area) due to the need for in-person attendance at courts, hearings, and enforcement operations.

What We Offer:

  • Work with top-tier global clients and international teams;
  • Competitive salary;
  • Opportunity to lead and shape BrandMonitor's legal operations in Brazil;
  • Remote-first work environment with flexibility;
  • Meaningful impact in the global fight against counterfeiting and intellectual property violations;
  • Career growth within a fast-growing international legal-tech company.
